Victorian Legal Regulator set to Investigate Lawyer Misconduct Allegations about Prime Minister Julia Gillard

A leading authority on Constitutional Law and History, Civil Political and Human Rights, and Legal Ethics, whistleblower, journalist and lawyer James Johnson has filed a formal complaint with the Victorian legal regulator, the Legal Services Commissioner, to trigger an investigation of media allegations of professional misconduct by Australian Prime Minister, lawyer, Julia Gillard.

“I am greatly disturbed about the widespread media reports containing allegations of unprofessional conduct / professional misconduct by the current Prime Minister of Australia Julia Eileen Gillard during the course of her employment in the 1990s as a senior solicitor – possibly even a salaried partner – with ASX Listed corporation and law firm Slater and Gordon.” Mr Johnson said.

These include allegations that hundreds of thousands of dollars of Australian Workers Union monies were misappropriated, and claims that some of these funds were used to purchase a house in which Ms Gillard and her then boyfriend, AWU official Bill Wilson, resided. There are allegations that incorrect statements were made to Western Australian union and other government officials. And it appears that Ms Gillard has confessed to not complying with even the most basic professional requirements of opening a file, making proper receipts and records of monies received and disbursed, and even of failing to issue invoices for legal work performed in connection with the scheme.

“Without a full and proper investigation by the proper regulatory authority, the public will never know whether Julia Gillard is guilty of any professional misconduct,” Mr Johnson said.

“Whether these allegations are true, as many assert, or are the defamatory works of “misogynous nut-jobs” as Ms Gillard elegantly asserts, the truth needs to be investigated and reported.”

It is no secret that Ms Gillard’s political party, the Australian Labour Party is almost certain to face its worst ever electoral defeat if Ms Gillard continues to lead the party at the next Federal election (which must happen no later than August 2013). Since she came to power in a questionable ‘coup’ by replacing first term Prime Minister Kevin Rudd in June 2010, VictoriaNew South WalesQueensland, and now this weekend, the Northern Territory ALP governments have all been swept aside in landslide elections of conservative, Liberal National Party Coalition Governments.

“There is every likelihood that Ms Gillard’s political career will be over very soon, if not next week, or next month, certainly by or before the next Federal election” Mr Johnson said. “ As they say, a week is a long time in politics. There is every likelihood that by this time next month, or next year, Ms Gillard would want to return to legal practice, presumably in Victoria again (where she may well, for all I know, continue to hold a Victorian issued Legal Practising Certificate). So it is in the public interest that her fitness to practice as a lawyer is fully investigated as soon as possible.”

Everthing will come out in the now inevitable Royal Commission into union finances and accountability, so it is in the best interest of the Victorian Legal Services Commissioner to be seen to be proactive in these matters, and demonstrate clearly that they are part of the solution and not part of the problem.

    It is well worth an hour listening to his taped speech given in Brisbane last Thursday night,6th Sept.,as I listened to the Sydney one and I’d say he has spoken to Bruce Wilson in between as he is now much more forceful.As Michael says, this country is not well served ,nor are our children given a correct role model, by having this woman at the Lodge

    If you’re serious about wanting to make a difference on this issue, the best way for you to achieve that would probably be to hook up with someone with a detailed and thorough knowledge of the issues, eg Michael Smith.     Great to see that you’re out there making a difference!

    Some constructive feedback on your letter that I hope may be of help:
    1. You don’t do yourself any favours by citing Larry Pickering – Larry peddles unsubstantiated gossip and malicious tittle tattle and this tends to undermine the bigger message that he’s trying to get across.
    2. The florid asides that you drop into your writings from time to time tend to detract from their overall impact – at times you sound more like a storyteller than a lawyer – more concise, focused and to-the-point would be much more effective in my humble opinion.

    Keep up the great work!

    May I point out I understand it is regarding a Bruce Wilson and your article states a Bill Wilson.
    Truth is needed for survival universally and shall Triumph*.
    Charles Darwin believed this also strongly.(smile sent)`Tis common sense really and the purpose of valid education also.
    May one wish you success earned and enjoyed.Truth in Justice `needs` to be affordable* Mr Johnson.Laws are supposed to `protect` the majority and shared society, as we do inadvertently …pay for a safe civil rational and reasonable Society ..they tell us.Many choose to believe that in OUR Australia .
